The uMkhonto weSizwe Party has criticized the South African Judiciary for the year-long delay in delivering the Phala Phala judgement involving President Cyril Ramaphosa. The party expressed support for the African Transformation Movement’s legal action and called for prompt resolution to restore public confidence in the judicial system.
The uMkhonto weSizwe Party (MK Party) has expressed concern over the prolonged delay in delivering the judgement in the Phala Phala case involving President Cyril Ramaphosa. The case stems from findings by the Independent Panel chaired by former Chief Justice Sandile Ngcobo in November 2022, which identified prima facie criminal conduct by the President.
The Phala Phala incident came to public attention in 2020 when reports emerged that a significant amount of foreign currency had been allegedly stolen from President Ramaphosa’s farm. The matter prompted investigations by state institutions and eventually led to the establishment of the Independent Panel to examine the circumstances and determine accountability.
After the release of the Ngcobo-led report in November 2022, the African Transformation Movement (ATM) pursued legal action as a party to the case, seeking judicial clarity. Since then, the matter has not been resolved, with the judgement remaining pending over a year later.
The MK Party also pointed to other longstanding unresolved judicial matters. Former President Jacob Zuma submitted an application to recuse Justice Raymond Zondo during the State Capture Inquiry. According to the MK Party, the application has not been adjudicated or finalized despite being submitted several years ago. The party argues this highlights inconsistencies in how the judiciary handles cases involving politically influential individuals.
Recent developments have added to concerns about judicial accountability. A sitting judge was arrested on charges of corruption and judicial capture. The MK Party described the arrest as an indication of challenges within the judiciary and the need for greater transparency and timely action.
MK Party spokesperson Nhlamulo Ndhlela said, “We are appalled by the year-long delay in delivering the Phala Phala judgement. This is a clear indication of selective inaction when politically powerful individuals are involved. The judiciary must act without fear or favour and ensure that justice is delivered without further delay.”
The party emphasised its support for the ATM in pursuing the case and reiterated its call for swift action. The MK Party also noted that delays in politically sensitive matters undermine public confidence in judicial institutions and the rule of law.
The MK Party concluded by urging the judiciary to prioritise transparency and accountability. It called for the immediate conclusion of the Phala Phala case to ensure justice is served and to reinforce trust in South Africa’s legal and political institutions.
