SAPS major-generals Feroz Khan and Ebrahim Kadwa granted R20 000 bail

Major General Feroz Khan, Hawks boss Ebrahim Kadwa and businessman Tariq Downes were granted R20 000 bail each in a Precious Metals Act case as the court warned against witness interference and ordered the confiscation of their passports.

Major General Feroz Khan, Major General Ebrahim Kadwa and Durban businessman Tariq Downes have each been granted R20 000 bail in a matter involving alleged contraventions of the South African Precious Metals Act and defeating the ends of justice.

The trio appeared at Kempton Park Magistrate’s Court on Monday.

The State did not oppose bail, saying the charges fall under Schedule 1 offences. NPA spokesperson Kaizer Kganyago said the prosecution would present its witnesses when the matter returns to court on July 14.

As part of their bail conditions, the accused’s passports were confiscated. The court ordered that they must notify the Investigating Officer at least three days in advance should they intend to travel outside South Africa.

The court also raised concerns about possible witness interference, particularly because Khan is employed by the South African Police Service (SAPS). The accused were instructed not to interfere with witnesses in any manner.

Electronic devices belonging to Accused 1 and Accused 2 have been seized for forensic analysis. Defence legal representatives requested that the court expedite the forensic investigation process relating to the mobile phones.

The state further revealed that one of the accused refused to provide access credentials for their cellphone, forcing investigators to apply for a warrant to gain access to the device. The process is expected to further delay the investigation.

The matter was postponed to July 14, 2026, to allow the state additional time to conduct further investigations.
