Former IDAC head Andrea Johnson and ex-Crime Intelligence deputy Feroz Khan granted R10 000 bail

Former IDAC head Andrea Johnson and former SAPS Crime Intelligence deputy head Feroz Khan have been granted R10 000 bail each after appearing in the Pretoria Magistrates’ Court on charges including assault with intent to do grievous bodily harm and defeating the administration of justice.

Former head of the Investigating Directorate Against Corruption (IDAC) Andrea Johnson and former deputy head of Crime Intelligence Feroz Khan have been granted R10 000 bail each following their appearance in the Pretoria Magistrates’ Court on Friday.

Johnson, 56, and Khan, 56, were arrested on October 30 following an investigation by the Commission’s Recommendation Task Team (CRTT).

Both face charges of assault with intent to do grievous bodily harm and defeating the administration of justice. Johnson is charged as an accessory after the fact in the alleged assault.

Johnson also faces an additional charge of contravening the National Prosecuting Authority (NPA) Act 23 of 1998.

The charges relate to an alleged assault involving Khan and his junior colleague, SAPS Crime Intelligence Brigadier Phethle, on June 26, 2018.

The NPA said Khan allegedly had a serious argument with Phethle before physically attacking her with a pen, stabbing her and hitting her with his hands and a paper file.

The alleged assault left Phethle with injuries to her face and chest.

Phethle reportedly opened a police case in June 2018.

However, the NPA alleges that Khan submitted a warning statement to the investigating officer on July 5, 2018, before the case docket had been submitted to the NPA for guidance and a decision.

This prompted an investigation into how Khan was able to submit the statement before the prosecuting authority had received the docket.

The investigation allegedly established that Johnson, who was then employed by the NPA, disclosed information to Khan without the permission of the National Director of Public Prosecutions (NDPP).

The NPA further alleges that Johnson and Khan acted with a common purpose to hinder Khan's prosecution.

At the time, Johnson was serving as Deputy Director of Public Prosecutions at the Pretoria office, while Khan held the rank of major-general and was attached to SAPS Crime Intelligence in Erasmuskloof, Pretoria.

The state did not oppose their release on bail, citing that they were not flight risks and that their residential addresses had been confirmed.

The court granted both accused bail of R10 000 each.

Johnson was ordered to surrender her passport to the investigating officer by November 4.

The matter was postponed to February 2, 2027, for further investigations.
