A Phokeng police constable accused of raping a 31 year old woman at the police station while assisting her with a domestic dispute has been granted R5 000 bail by the Phokeng Magistrate’s Court. The case, investigated by IPID, has been postponed to 26 February 2026 for further investigation.
A 27-year-old police constable based at Phokeng Police Station in Rustenburg has been released on R5 000 bail following his appearance in the Phokeng Magistrate’s Court on 22 December 2025, where he faces a rape charge.
According to the Independent Police Investigative Directorate IPID, the constable is accused of raping a 31 year old woman who had approached the police station for assistance with a domestic dispute involving her partner. The alleged incident took place on 2 December 2025 at the Phokeng Police Station.
IPID said the constable was on duty when he attended to a complaint involving the complainant and her boyfriend. Both parties are foreign nationals. It is alleged that during the interaction, the constable released the boyfriend and instructed him to go home to fetch his passport, which he was asked to bring back to the police station. The girlfriend was allegedly kept behind at the station.
The complainant alleges that after her boyfriend had left, the constable took her to an office within the police station premises where he raped her. In an earlier statement, IPID said the complainant further alleged that the constable threatened to arrest her before taking her to the office.
The matter was reported and IPID took over the investigation on 11 December 2025, as the case involves a serving member of the South African Police Service. IPID confirmed that the accused constable was positively identified by the complainant during an identity parade.
Following the identification, the constable was arrested and detained at a local police station ahead of his first court appearance. He appeared in court on 15 December 2025, where the matter was postponed, and later returned to court on 22 December 2025 for a bail hearing.
The Phokeng Magistrate’s Court granted the accused R5000 bail. The case has been postponed to 26 February 2026 to allow for further investigation.
IPID said investigations are continuing and reiterated its commitment to ensuring accountability where members of the police are accused of criminal conduct.
