State alleges Brown Mogotsi planned escape from court cells

The State has alleged that accused businessman Brown Mogotsi was planning to escape from court custody, telling the Johannesburg Magistrate’s Court that he allegedly intended to disguise himself as a correctional services officer and make a run for freedom.

The allegation was made as the State opposed Mogotsi’s fourth application for bail on Tuesday, 25 August 2026.

Mogotsi is seeking his release on what his defence says are new facts. His previous attempts to secure bail have failed, including an unsuccessful challenge in the Johannesburg High Court.

According to the State, however, the latest bail bid comes against the backdrop of an alleged escape plan that was supposedly being considered on 20 August.

The State claims Mogotsi planned to disguise himself as a correctional services officer before attempting to flee from the court cells.

The allegation adds another layer to an already closely watched bail battle, with prosecutors previously raising concerns about witness safety and alleged intimidation.

Mogotsi has been in custody since his arrest in May following allegations that he staged an assassination attempt against himself in Vosloorus in November 2025. He faces charges including perjury, defeating or obstructing the ends of justice, unlawful possession of a firearm and ammunition, and discharging a firearm in a public place.

His defence maintains that the fourth bail application is based on new information. Earlier reports indicated that the new facts relate to a new address where Mogotsi would reside if released on bail.

The State has also previously raised concerns about possible witness intimidation, after allegations that Mogotsi’s wife visited a witness whose address had been disclosed in court. The court subsequently ordered that the names and addresses of witnesses be protected.

The latest escape allegation is expected to weigh heavily in the State’s argument as it seeks to keep Mogotsi behind bars.

Mogotsi remains presumed innocent unless and until proven guilty in court.
