Sibiya denies raping 18-year-old, says sexual intercourse was consensual

Suspended Deputy National Police Commissioner Shadrack Sibiya has denied raping an 18-year-old woman, telling the Randburg Magistrates’ Court that their sexual intercourse was consensual.

Sibiya is applying for bail in a case in which he faces charges including rape and sexual grooming.

During his bail application on Tuesday, Sibiya disputed the State’s allegations, saying the 18-year-old was not under duress or in a vulnerable state when they had sexual intercourse.

He told the court that he found the young woman at the Garden Court hotel with Mr M and other people. They later went to The Grand, after which he returned to the Garden Court with her.

Sibiya maintains that the sexual encounter at the hotel was consensual and denies the State’s allegation that he plied the young woman with alcohol before raping her.

The suspended police official also addressed other allegations contained in the charge sheet, saying some of the charges appeared to be duplications. He said he had grouped them together when providing his version of events.

Sibiya further told the court that he was unsure of the exact dates of some of the alleged incidents and had therefore responded on the assumption that they occurred on the dates listed in the charge sheet.

In relation to other counts, Sibiya said Mr M and his sister hosted a braai in Kempton Park, to which he had been invited.

He said Mr M later asked him to collect his daughter, identified as ZM, from Centurion and provided him with her contact details.

Sibiya said that about a week later, Mr M visited him at his home and told him that he had received a video of ZM masturbating from an undisclosed source. According to Sibiya, Mr M also told him that ZM had a crush on him and contacted her in his presence.

Sibiya has also told the court that he is the primary breadwinner in his household and described himself as a viable economic asset to the country.

The State has formally stipulated that assertions made during the bail proceedings may be used against Sibiya during the trial.

The prosecution has previously maintained that its case against Sibiya is strong.

The bail application has been postponed to 1 October, and Sibiya will remain in custody.
