EFF takes impeachment committee decision on evidence leader to court

The EFF has launched an urgent court application challenging Parliament's Impeachment Committee decision to withdraw its nomination of Advocate Griffiths Madonsela as Chief Evidence Leader.

The Economic Freedom Fighters (EFF) have approached the Western Cape High Court seeking to review and set aside a decision by Parliament's Impeachment Committee to rescind its nomination of Advocate Thandazani Griffiths Madonsela SC as Chief Evidence Leader.

In court papers on Monday, the EFF is asking for the matter to be heard on an urgent basis.

The party wants the court to declare unlawful and set aside the committee's decision, taken on 1 September 2026, to withdraw its recommendation of Madonsela for the position.

The EFF is also seeking an order preventing the Impeachment Committee from appointing or recommending another person as Chief Evidence Leader for the relevant investigative process.

According to the notice of motion, the party further wants the court to review any decision taken in terms of a parliamentary resolution adopted on 5 August 2026, where such a decision is inconsistent with that resolution.

The Speaker of the National Assembly, the Chairperson of the Impeachment Committee, President Cyril Ramaphosa and Madonsela have been cited as respondents in the matter.

The application is supported by an affidavit from EFF leader Julius Malema and is set down to be heard in the Western Cape High Court on 18 September 2026.
