NDPP orders withdrawal of charges against Crime Intelligence boss Dumisani Khumalo and co-accused

National Director of Public Prosecutions (NDPP) Advocate Andy Mothibi has directed that criminal charges against Crime Intelligence head Lieutenant General Dumisani Khumalo and seven co-accused be withdrawn, pending the completion of further investigations.

In a letter addressed to the accused's legal representatives, Mothibi said representations submitted by the defence were considered alongside a memorandum from the Investigating Directorate Against Corruption (IDAC).

According to the letter, IDAC advised that its investigation remains incomplete and that additional investigative steps are required before a proper prosecutorial decision can be made.

"In these circumstances, I have exercised the supervisory powers contemplated in Section 179(5)(c) of the Constitution and have directed that the charges be withdrawn before plea in terms of Section 6(a) of the Criminal Procedure Act," Mothibi stated.

He added that because the investigation has not yet been finalised and a complete evidential record is not yet available, it would be premature to make a final determination on the review requested by the accused at this stage.

Mothibi further directed that the matter may not be re-enrolled without his prior written approval, effectively placing any future prosecution under the direct oversight of the NDPP.

The case relates to Lieutenant General Khumalo and seven others facing criminal charges under Pretoria Regional Court case number A16/463/2025. While the charges have been withdrawn for now, the decision does not amount to an acquittal, and the investigation by IDAC remains ongoing.
